Rutherford, 40, who is three months pregnant, filed for divorce on Dec. 30, citing "irreconcilable differences," as TMZ first spotted her divorce attorney and obtained legal papers.
Playing serial divorceé Lily van der Woodsen, she is imitating her character - the second time this time and with a baby on the way.
Giersch and Rutherford, who is expected on the Gossip set in New York Tuesday, also have a 2-year-old son, Hermés Gustaf Daniel Giersch.
