"After reviewing the case, we've declined to file any charges due to insufficient evidence," said D.A. spokeswoman Jane Robison.

Cast member Shia LaBeouf poses at the premiere of "Transformers" at the Mann's Village theatre in Los Angeles June 27, 2007 |
LaBeouf and his passenger, "Transformers 2" costar Isabel Lucas, were both taken to Cedars by ambulance after the crash. Lucas was released later that day after being treated for minor injuries.
The 22-year-old actor was cited with misdemeanor DUI while he was still at the hospital.
Although the D.A. rejected the case, LaBeouf still faces a DMV hearing and the possible suspension of his driver's license.
"When an individual refuses to take a blood alcohol test, that person's license is automatically suspended for six to nine months," says L.A. County Sheriff's spokesman Steve Whitmore.
LaBeouf is not required to attend and will not be, according to his attorney Michael Norris.
